The Texas Family Code contains standard guidelines for the calculation of child support. Generally, one parent (or party) will be named as the conservator with the right to collect child support from the other parent (obligor).
The court will apply the following schedule, assuming the obligor's net monthly resources are less than $6,000.00:
- 1 child 20% of Obligor's Net Resources
- 2 children 25% of Obligor's Net Resources
- 3 children 30% of Obligor's Net Resources
- 4 children 35% of Obligor's Net Resources
- 5 children 40% of Obligor's Net Resources
- 6 or more children Not less than 40%
If the obligor has children from another party, the above percentages may be lowered. If the obligor's net monthly resources exceed $6,000.00, the court may order support exceeding the above percentages.
Medical support, the obligor must also cover the child with medical insurance, or reimburse the other party the cost of such coverage. This cost is deducted from the obligor's gross resources in determining net resources. Child support generally will continue until the child is eighteen (18) years of age or graduated from high school (whichever occurs last).
